Sciatica and Military Service: Get the Benefits You Deserve
Accredited VA Disability Attorney, Zack Evans explains VA claims for Sciatica.
Sciatica, or “lumbar radiculopathy,” occurs when irritation, inflammation, or some type of damage affects the sciatic nerve. Sciatica causes pain, numbness, and muscle weakness. In severe cases, it can also cause urinary or bowel incontinence.
Sciatica is a common health issue, with about 40% of people in the U.S. experiencing it at any point in their lives in some form. However, veterans are considered at a higher risk for sciatica because of service-related injuries or wear and tear on the back. Specifically, veterans are 12.2% more likely to experience sciatica than the general population.

    If the Veteran is 100% rated disabled, that status IS always service connected, and if the his/her spouse have been married for 10 years from the date of the 100% award letter then the spouse DOES qualify. Currently - 2024 there is a Bill working it's way through the Senate that would not only increase the amount given to the surviving spouse but reduce the time to 5 years. The "Caring For Survivors Act".

    What about it being claimed as a secondary?

    • @woodslawyers
      @woodslawyers 10 дней назад

      You must first prove your primary service-connected disability to prove a secondary service connection. Proving a service connection relies on evidence such as medical treatment, diagnosis, opinions of medical and psychological professionals, and statements from friends, family, and veterans who served with you. To obtain secondary service connection, you need to file a VA application claiming service connection for these health issues. You must be able to prove these issues are caused by or made worse by a service connected health condition through medical evidence. You can learn more about secondary service connection here: www.woodslawyers.com/va-disability-list-secondary-conditions/?.com&DirectServiceConnectionshort&CommentShare

      Before the VA will award disability compensation, a veteran must present evidence that their health conditions are related to their military service - a concept called service connection. VA disability benefits are awarded to veterans with service-connected conditions. That makes the medical nexus letter one of the most important pieces of evidence in a VA disability case.

    If I got placed on TDIU and I work part time for my dad at his company. Do I inform the VA ? Is there a specific way? I don’t make much; it’s a tad bit above the poverty line. Thanks

    • @woodslawyers
      @woodslawyers Месяц назад

      Veterans receiving TDIU benefits have service-related medical conditions preventing them from maintaining substantially gainful employment. The VA defines substantially gainful employment as “employment at which non-disabled individuals earn their livelihood with earnings comparable to the particular occupation in the community where the veteran resides. It suggests a living wage.” If the employer is making special accommodations because of a veterans’ medical needs, the job would be considered sheltered or protected employment, which is not substantially gainful employment. If a veteran is employed in a sheltered work environment, they may still be considered for TDIU benefits, even if the job’s income is above the poverty line.

      It’s common for a person to develop both GERD and IBS. The two conditions have similar symptoms and impact similar regions of the body. Veterans can receive a VA disability rating between 0% and 80% for GERD, depending on the severity of symptoms they experience and how much it impacts their health. If a veteran’s GERD is linked to their service-connected IBS, they could be owed additional monthly VA compensation for GERD. It's hard to answer your question without knowing more details about your case. However, when a person undergoes gallbladder removal, they will often resolve many of the symptoms related to their condition. However, if the symptoms continue, you will likely still receive a gallstone VA disability rating. The rating for gallbladder removal is: 0% - for asymptomatic cases 10% - if you experience mild symptoms 30% - if you continue to suffer from severe symptoms
